1. Eligibility: Entry is open only to persons 18 years and over, who are residents of Colorado and have not won a competition, prize, or received a promotional item from Vita Brevis Fine Art in the last 24 months. The Campaign is open to legal residents of the United States and is void where prohibited by law. Employees of Vita Brevis Fine Art, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers (collectively, the “Employees”), and immediate family members or those living in the same household of Employees are not eligible to participate. The Campaign is subject to all applicable federal, state, and local laws and regulations.

2. Agreement to Rules: By participating in this Campaign, you (“Contestant”; or “You”) agree that you have read these terms and conditions, you understand them, and you agree to them, representing and warranting that you meet all eligibility requirements. You also agree to accept the decisions of Vita Brevis Fine Art as final and binding as they pertain to the Campaign. If you do not agree with any of the terms described in these Terms and Conditions, you agree you will not participate in this Campaign.

3. Campaign Period: Entries will be accepted online.

4. Entry Requirements: Entries must meet all Campaign requirements to qualify for a prize. Incomplete entries or those not adhering to the rules may be disqualified at Vita Brevis Fine Art’s sole discretion. You may enter only once and must provide the requested information. Multiple entries by using different emails, identities, or devices to circumvent rules are prohibited and may result in disqualification.

5. Prizes: Winners will receive a Studio Portrait Session and Artwork for their home. The actual/appraised value may differ at the time of the prize award. Vita Brevis Fine Art will solely determine prize specifics. No cash or other substitutions are permitted unless solely at Vita Brevis Fine Art's discretion. Prizes are non-transferable, and any prize- related expenses, including taxes, are the responsibility of the Winners. Acceptance of the prize constitutes permission for Vita Brevis Fine Art to use Winner’s name, likeness, and entry for advertising and trade without additional compensation, unless prohibited by law.

6. Odds: Odds of winning depend on the number of eligible entries received.

7. Winner Selection and Notification: Winners will be selected under the supervision of Vita Brevis Fine Art and notified by phone, text, and email within five (5) days. By providing your phone number, you consent to receive text messages from Vita Brevis Fine Art; message and data rates may apply. Vita Brevis Fine Art is not responsible for any winner’s failure to receive notifications due to spam filters, incorrect contact information, or other issues. Failure to respond or meet eligibility requirements may result in forfeiture, and an alternate winner may be selected.

8. Rights Granted by You: By entering, you grant Vita Brevis Fine Art the right, where permitted by law, to print, publish, broadcast, and use your entry, name, likeness, image, statements about the Campaign, and biographical information for promotional purposes without additional compensation. Entries must be original works, not infringing on third-party rights. You agree to indemnify Vita Brevis Fine Art against claims from third-party rights infringements.

9. Terms & Conditions: Vita Brevis Fine Art reserves the right to cancel, terminate, modify, or suspend the Campaign if it is corrupted by a virus, bug, or other technical issues beyond its control. Vita Brevis Fine Art may disqualify any entrant tampering with the entry process or violating these Terms & Conditions. Attempting to damage any website or disrupt the Campaign may be a violation of criminal and civil laws; Vita Brevis Fine Art reserves the right to fully seek damages permitted by law.

10. Limitation of Liability: By entering, You agree to release and hold Vita Brevis Fine Art, its subsidiaries, affiliates, agents, and employees harmless from liability related to: (i) participation in the Campaign; (ii) acceptance, use, or misuse of any prize; (iii) technical failures; (iv) unauthorized human intervention; and (v) errors in entry processing.

11. Disputes: This Campaign is governed by Colorado and United States law, without respect to conflict-of-law doctrines. Participants agree to resolve disputes exclusively in Colorado courts, waiving rights to punitive, incidental, or consequential damages, except for actual out-of-pocket expenses.

12. Privacy Policy: Information submitted with an entry is subject to the Vita Brevis Fine Art. Privacy Policy available on its website.

13. Winners List: For a copy of the Winners’ names or these Official Rules, send a request with a stamped, self-addressed envelope to Vita Brevis Fine Art, 525 E Fountain Blvd, Suite #110, Colorado Springs, CO 80903, by December 31, 2024.

14. Sponsor: The Campaign Sponsor is Vita Brevis Fine Art.

15. Social Media: This Campaign is not sponsored, endorsed, administered by, or associated with Facebook, Instagram, or TikTok.

16. Non-Disparagement: You agree not to make, encourage others to make, or ask others to make disparaging statements, reviews, or comments about Vita Brevis Fine Art, including online and social media posts. You also agree that if you make disparaging statements online or through social media posts that you will likely diminish the commercial reputation of Vita Brevis Fine Art. If you believe you have grounds to make disparaging statements about Vita Brevis Fine Art, you agree to contact Vita Brevis Fine Art by mailing your written letter containing a draft of the statement you intend to make to the address below using a mail service that will confirm your letter was delivered at least twenty-one (21) days before you intend to make the statement online or through a social media post.

17. Reservation Fee: To ensure high-quality, personalized service, a refundable $250 reservation fee is required to secure a portrait session. Cancellations or rescheduling require a one-week notice. Failure to show without notice will result in forfeiture of the prize and reservation fee. Framing and shipping costs are not included.
